Service Agreement
1-PARTIES OF THE CONTRACT
In this contract, the real person or legal entity who becomes a member to use the content on the
internet address named www.funnynative.com determined by the site by the parties as the "BUYER", is
the "Saas Computer Rek. Singing. ve Tic. LTD ŞTİ is defined as "Site". The site named
www.funnynative.com will be briefly named as "Site".
2-GENERAL PROVISIONS
The site is a platform that brings together professional English instructors and users who want to
practice English. The following rights and obligations apply to all site users (instructors, users
and all other user types).
Site membership is personal, membership or service purchase cannot be made on behalf of someone else.
Only users over the age of 18 can use Siye.
This contract has been arranged to determine the membership conditions and terms of use of the
program at the website determined by the Site. Every buyer who has started his membership is deemed
to have read and accepted all the current terms of the contract below.
The fee for the usage packages determined by the site only covers the single-user use of the program
over the internet, with internet browsers and / or mobile applications.
When registering on the site, name, surname, telephone, e-mail etc. information must be entered
completely and correctly. In cases where this information is incomplete or inaccurate, the Site
reserves the right to make changes in this member's profile, suspend or cancel the membership of
this member without any warning. The Site is not responsible for any malfunctions that may occur due
to incomplete or incorrect information given while becoming a member.
The Site is not responsible for any damages that may arise from unauthorized reading or modification
of member information due to the member's negligence.
The data uploaded to the site by users are permanently deleted 3 (three) months after the membership
expires. Users can receive their uploaded data within these 3 (three) months after their membership
termination, otherwise the site accepts no responsibility. Since 100% guarantee cannot be given in
security and storage technologies in services provided over the Internet, "User" is responsible for
the security and backup procedures of the documents uploaded to the system.
A contract cannot be sold for more than one natural or legal person. The right of use cannot be
transferred to third parties with or without a charge.
All responsibilities of the issues shared in the blog, social network etc. modules within the site
belong to the person / user who shared it. Person; He / she is responsible for every sharing he /
she makes anonymously or visibly. No responsibility can be placed on the Site in this regard.
Users are unlawful, threatening of any kind, which constitutes a criminal offense, requires legal
follow-up, or contravenes local, national or international law, or simply creates a situation that
will offend another user, or encourage any of these situations, publish, sell or transmit insulting,
abusive, humiliating, vulgar, pornographic, disturbing, and contrary to the purpose of the site.
The Buyer agrees and undertakes to comply with and not violate the provisions of the Law on
Intellectual and Artistic Works, the Decree Law on the Protection of Trademarks, the Decree Law on
the Protection of Patent Rights, the Turkish Commercial Code, the Turkish Penal Code, the Code of
Obligations and other relevant legislation.
Users are obliged to enter the correct information during membership registration. The user accepts
and undertakes that the personal information entered is up-to-date and accurate. The Site has the
right to terminate the service received by the user in cases where the lack and / or accuracy of
this information cannot be ensured.
For any reason, the user's requests for termination and return outside the legal period are not met
by the Site.
Site-related changes will be sent via SMS to the e-mail addresses and / or mobile phones that users
notify while signing up. The Site is not responsible for any damages incurred by users due to
changes and updates that cannot be notified to users due to an invalid e-mail address or telephone
number.
The user has agreed to receive all messages sent from the Site to the e-mails and / or phones he /
she has reported while signing up. The site may use the e-mail and mobile phone numbers provided by
the recipient in its other business ventures. If there is a change in e-mail and phones, this will
be reported to the Site. Otherwise, all information and update messages by the Site will continue to
be sent to the e-mails and phones declared while signing up.
All recorded data of users are kept confidential and cannot be seen by third parties. For the
avoidance of doubt in good faith, the Site maintains its best security standards for the
confidentiality of this information. This information is shared with the competent authorities only
if requested by the prosecution and police authorities.
What you talk about in the interviews remains between you and the expert, unless you give permission
within the framework of confidentiality policy. This does not apply if you hurt yourself or someone
else, and your specialist can share information about you with anyone they think is necessary.
Your information can be used for academic elements and / or technological developments by being
anonymized by the site.
If you do not answer the phone or video call at the time of your appointment, you will lose your
right and will not be refunded. The users are responsible for being early or late.
It is not the responsibility of the Site to search the police or related unit in case of emergency.
If the expert you interviewed deems appropriate, he / she may intervene or make a notice.
The site has the right to develop and update content, graphic and design within any time frame. The
site also reserves the right to change, remove or add new features used.
Instructors are responsible for the service they will provide to other users or other third parties
and they accept and undertake in advance that they will provide these services in accordance with
ethical rules. The site does not take responsibility or become a party for the services that the
instructors cannot provide.
The site reserves the right to suspend the broadcast of the program temporarily at any time for
maintenance and update purposes and to stop it completely for prior notice. Members are not deprived
of using the system until the end of the service they have paid for.
The software product, the accompanying printed materials and the software product (including but not
limited to any images, photographs, animation, video, sound, music, text and mini-application added
to the software product and new recording systems due to developing technologies) All savings and
copyrights of the copies belong to the Site.
In accordance with the Security and Privacy Policy, the Site cannot be held responsible for any
material or moral damages arising from the misuse of the site or the content of the page. Due to the

internet-connected services and cannot be promised 100% security, it undertakes to take all kinds of
security measures in the `` Site '' software and to eliminate the possible deficiencies and gaps

due to errors, deficiencies and / or deficits that are made inadvertently or edited or arise over
time and / or are not noticed. The user is deemed to have accepted these terms of use.

All rights of the site software belong to Saas Bilgisayar, Reklam Tel. Singing. Tic. LTD ŞTİ. The
design, graphics and content used cannot be copied. It cannot be reproduced, distributed or marketed
without permission. Otherwise, the relevant laws and provisions regulated by the Turkish Penal Code
under the title of Information Crimes will be applied. The cancellation of the usage rights of the
members determined to have violated such rules is at the initiative of the Site.
In the event that the buyer acts against the provisions of this contract, the Site may immediately
terminate this contract unilaterally. In this case, the member's user account is frozen. The data of
the member will continue to be stored by the system for 3 (three) months and will be deleted at the
end of this period.
Cookies (cookies / cookies) are used in the system, cookies are pieces of information that a website
transfers to the cookie file on the hard disk of the user's computer, they allow users to navigate
the site and when necessary, it helps to prepare content suitable for the needs of users accessing
the site.
Users and trainers; threatening, immoral, racist laws of the Republic of Turkey, contrary to
international agreements with content services, messages, photos, text can not share.

purchased by the user is not provided, the Site will be refunded and canceled, provided that the
user is informed.
If an error occurs in the price and feature information of the services offered for sale on the site,
the Site may inform the users, provide services to correct this error or cancel the order.
In online payments, if the card is used illegally by someone other than the holder, the Bank Cards
and Credit Cards Law No. 5464 dated 23.02.2006 and the provisions of the Regulation on Bank Cards
and Credit Cards published in the Official Gazette dated 10.03.2007 and numbered 26458 makes.
Within the scope of the Regulation on Distance Contracts, users have the right to withdraw from the
service they have purchased and the performance of the service before 1 day and within 14 (fourteen)
days without any justification and without penal terms.
The information, photos, links on the site cannot be copied and used for another service.
Members can unsubscribe if they wish and at any time. In the same way, the site has the right to
cancel the membership without warning or showing any reason.
The site is not responsible for failing to fulfill its obligations specified in this contract due to
errors arising from causes other than its own initiative, such as mechanical, electronic or
communicative failure or malfunction.
The site is not responsible for any incident that may occur due to the carelessness, recklessness,
irresponsibility or fault of the instructors or users. The damages caused by the users to each other
will not be recourse to the Site.
Users and trainers are personally responsible for all acts that cause loss of life or property or
constitute a crime under the Turkish Penal Code.
The Site is not responsible for any damages that may occur to them or other users due to the users
and instructors not complying with the conditions specified in this contract.
Members, within the scope of the Law on the Protection of the Consumer and the Law on the Regulation
of Electronic Commerce, the Site has the capacity of an Intermediary Service Provider that mediates
the establishment of a distance contract and by controlling the content provided by the Members, it
is necessary to mention an illegal activity or situation regarding the goods and services subject to
this content or content. they accept, declare and undertake that they are not obliged and
responsible to investigate whether the Users assume that all responsibility arising from the
provision of the service lies with the instructor; They acknowledge, declare and undertake that the
website is not a party to the Distance Sales Contract between trainers and other users and that it
has no liability arising from the Distance Sales Contract.
Users also accept and undertake to abide by the following rules while using the site;

contrary to general morality, indecent, indecent, pornographic, humiliating, defamatory, abusive,

Users cannot access the instructors from their social media accounts, send messages or disturb them
in any way.
If the trainer shares his contact information with users, he accepts that he is responsible for all
damages and unwanted situations that may arise.
Users cannot request (money, credit, credit card information), share their own bank account
information and / or attempt to fraud with the aim of obtaining financial benefit.
Users cannot share their personal information (e-mail, telephone, address, etc.) with each other in
any way.
Attempting to go beyond the laws of the Republic of Turkey and Turkish family upbringing during the
meeting,
Insulting statesmen or not making degrading gestures or speeches,
During the meeting; religion, politics, racism, sexuality, pornography, etc. Not talking about such
matters, not taking such actions,
Our site cannot be held responsible for the speeches made by the users during the interview. When the
user encounters an uncomfortable situation, he should report this to the site via e-mail.
The site cannot be used for any purpose other than English education or training appointments
(meeting in the real world without notifying the Site in writing and without the consent of the
site, gathering by specifying an address or meeting place, etc.). can not be held responsible.
During the conversation, users cannot advertise and promote other sites, brands, products, or
different products with service value. Users who engage in such behavior will be kicked out of the
system and blocked.
Experts dismissed from the platform agree and undertake to provide services even if they do not
appear on the main page until their processes with their current students / users are completed.
It accepts that they are responsible for all damages that may arise when they go beyond the rules
listed above and that the Site is not responsible for these damages. In addition, the site reserves
the right to remove or block users who engage in such behavior from the system or to report to the
competent authorities.
Users accept that the Site has the right to recourse to them within the scope of the Site membership
agreement and other rules on the site, in case the Site suffers any damage, including administrative
and judicial decisions, arising from the distant sales contract between them.
The conclusion of the Distance Sales Agreement will not prevent the execution of the provisions of
these membership agreements that the Members have signed separately with the Site, and the Members
accept and declare that the Site is not a party to the sale of the service in the distance sales
contract and that they have no responsibility and commitment to the parties to fulfill their
obligations under the Agreement. .
If any provision of this contract is deemed unenforceable or void, this invalidity is limited to this
only and the remainder of the contract remains in full force.
In all cases legally deemed force majeure, the parties are not liable for late or non-performance of
any of their commitments arising from this contract and the project. These and similar situations
will not be deemed as delay and non-performance or default for the parties, or any compensation
liability will not arise for these situations. The term "force majeure" shall be interpreted as
events that are beyond the reasonable control of the relevant party and that the parties cannot
prevent despite their due diligence. In the event of a force majeure event, one party may notify the
other party within 15 (fifteen) days by any means to suspend the provisions of the Contract, and if
the force majeure event lasts more than three months, the parties may terminate the contract.
The Parties agree that the Istanbul Courts and Enforcement Offices are authorized to resolve any
disputes arising from this contract.
This contract is valid from the date the buyer becomes a member of the system until he terminates his
membership.

1-SÖZLEŞMENİN TARAFLARI
Bu sözleşmede, taraflardan sitenin belirlediği www.funnynative.com isimli internet adresindeki
içeriği kullanmak üzere üye olan gerçek kişi ya da tüzel kişilik
“ALICI” olarak, www.funnynative.com sitesinin kullanım hakkını alıcıya sağlayan
‘’Saas Bilgisayar Rek. San. ve Tic. LTD ŞTİ “Site” olarak tanımlanmıştır.
www.funnynative.com isimli site ise kısaca “Site” olarak adlandırılacaktır.
2-GENEL HÜKÜMLER
Site, Profesyonel İngilizcesi olan eğitmenlerle, ingilizce pratik yapmak isteyen kullanıcıları bir
araya getiren bir platformdur. Aşağıdaki hak ve yükümlülükler tüm site
kullanıcıları (eğitmenler, kullanıcılar ve diğer tüm kullanıcı tipleri) için
geçerlidir.
Site üyeliği kişiseldir, başkası adına üyelik veya hizmet alımı gerçekleştirilemez.
Siye’yi sadece 18 yaşın üstünde olan kullanıcılar kullanabilir.
İşbu sözleşme Sitenin belirlediği internet adresindeki programın üyelik koşulları ve
kullanım şartlarını belirlemek üzere düzenlenmiştir. Üyeliğini başlatmış olan her
alıcı aşağıdaki sözleşmenin mevcut tüm şartlarını okumuş ve kabul etmiş sayılır.
Site tarafından belirlenmiş kullanım paketlerinin ücreti sadece programın internet
üzerinden, internet tarayıcıları ve/veya mobil uygulamalar ile tek kullanıcılık kullanımını
kapsamaktadır.
Siteye üye olurken ad, soyad, telefon, e-posta v.s. bilgileri tam ve doğru girilmelidir. Bu
bilgilerin eksik olduğu veya doğru olmadığı durumlarda Site, bu üyenin profilinde herhangi bir
uyarıda bulunmadan değişiklik yapma, bu üyenin üyeliğini askıya alma veya iptal etme
hakkını saklı tutar. Üye olurken verilen bilgilerin eksik veya hatalı olması nedeniyle meydana
gelecek aksaklıklardan Site sorumlu değildir.
Üye bilgilerinin üyenin ihmali dolayısıyla yetkisiz kişilerce okunmasından veya
değiştirilmesinden dolayı gelebilecek zararlardan Site sorumlu değildir.
Kullanıcılar tarafından siteye yüklenen veriler üyelik sona erdikten 3(üç) ay
sonra kalıcı olarak silinir. Kullanıcılar, üyeliğini sonlandırdıktan sonraki bu
3(üç) ay içerisinde yüklediği verilerini alabilir, aksi takdirde site
hiçbir sorumluluk kabul etmez. İnternet üzerinden sağlanan servislerde güvenlik ve
depolama teknolojilerinde %100 garanti verilemediğinden ‘’Kullanıcı’’
sisteme yüklediği evrakların güvenliğinden ve yedekleme işlemlerinden kendisi sorumludur.
Sözleşme ile birden fazla özel veya tüzel kişi için satış
gerçekleştirilemez. Kullanım hakkı, bedelli ya da bedelsiz olarak
üçüncü kişilere devredilemez.
Site içerisinde yer alan blog, sosyal ağ vb modüllerin içinde paylaşılan
hususların her türlü sorumluluğu bunu paylaşan kişiye/kullanıcıya aittir. Kişi; anonim ya
da görünür biçimde yaptığı her paylaşımdan kendisi sorumludur. Bu konuda
Siteye hiçbir sorumluluk yüklenemez.
Kullanıcılar, suç teşkil edecek, yasal açıdan takip gerektirecek ya da yerel, ülke
çapında veya uluslararası düzeyde yasalara ters düşecek, ya da yalnızca diğer bir
kullanıcıyı rahatsız edecek bir durum yaratan, ya da bu durumlardan herhangi birini teşvik eden,
hiçbir tür yasadışı, tehditkar, hakaret, küfür içeren,
küçük düşürücü, kaba, pornografik, rahatsız edici, ahlaka ve
sitenin amacına aykırı bilgi yayımlayamaz, satamaz ve iletemez.
Alıcı, Fikir ve Sanat Eserleri Kanunu, Markaların Korunması Hakkında Kanun Hükmünde
Kararname, Patent Haklarının Korunması Hakkında Kanun Hükmünde Kararname, Türk
Ticaret Kanunu, Türk Ceza Kanunu, Borçlar Kanunu ve diğer ilgili mevzuat
hükümlerine riayet etmeyi ve ihlal etmemeyi kabul ve taahhüt eder.
Kullanıcılar üyelik kaydı yapılırken doğru bilgileri girmekle yükümlüdür.
Girilen kişisel bilgilerin güncel ve doğru olduğu kullanıcı tarafından kabul ve taahhüt
edilir. Bu bilgilerin eksikliği ve/veya doğruluğundan emin olunamadığı durumlarda Site, kullanıcının
aldığı hizmeti sonlandırma hakkına sahiptir.
Her ne sebeple olursa olsun kullanıcının yasal süre dışındaki fesih ve iade talepleri Site
tarafından karşılanmaz.
Site ile ilgili değişiklikler, kullanıcılara üye olurken bildirdikleri e-posta adreslerine
ve/veya cep telefonlarına SMS olarak gönderilecektir. Geçersiz bir e-posta adresi veya
telefon numarası bildirilmesinden dolayı kullanıcılara bildirilemeyen değişiklikler ve
güncellemeler dolayısıyla kullanıcıların uğrayacağı zararlardan Site sorumlu değildir.
Kullanıcı, üye olurken bildirmiş olduğu e posta ve/veya telefonlara, Siteden gönderilecek
tüm mesajları almayı kabul etmiştir. Site, alıcı tarafından bildirilen e-posta ve cep telefonu
numaralarını kendisinin diğer ticari girişimlerinde kullanabilir. E-posta ve telefonlarda
değişiklik olması halinde bu durum Siteye bildirilecektir. Aksi takdirde Site tarafından tüm
bilgilendirme ve güncelleme mesajları üye olunurken beyan edilen e-posta ve telefonlara
gönderilmeye devam edilecektir.
Kullanıcıların kayıtlı tüm verileri gizli tutulur ve üçüncü kişilerce
görülemez. İyi niyetli bir şekilde şüpheye mahal bırakmamak adına Site, bu bilgilerin
gizliliği için elinden gelen güvenlik standartlarını sağlar. Bu bilgiler yalnızca
savcılık ve emniyet yetkilileri tarafından istenildiği takdirde yetkili makamlarla paylaşılır.
Görüşmelerde konuştuklarınız, gizlilik ilkesi çerçevesinde sizin izin
vermediğiniz sürece uzman ile aranızda kalır. Bu durum, ancak, kendinize ya da bir başkasına
zarar vermeniz söz konusu olduğunda geçersiz kalır ve uzmanınız sizinle ilgili bilgileri
gerekli gördüğü kişilerle paylaşabilir.
Bilgileriniz, site tarafından anonimleştirilerek akademik unsurlar ve/veya teknolojik geliştirmeler
için kullanılabilir.
Randevu saatinizde telefona ya da görüntülü aramaya cevap vermemeniz halinde
hakkınızı kaybedersiniz ve ücret iadesi yapılmaz. Erken veya geç kalınmasının
sorumluluğu kullanıcılardadır.
Acil durumlar halinde polis veya ilgili birimin aranması Site'nin sorumluluğunda değildir.
Görüştüğünüz uzman uygun görürse bu konuda herhangi bir
müdahalede veya ihbarda bulunabilir.
Site dilediği zaman dilimi içerisinde içerik, grafik ve tasarım geliştirme ve
güncelleme yapabilme hakkına sahiptir. Site ayrıca kullanılan özellikleri değiştirme,
kaldırma veya yeni özellikler ekleme hakkına sahiptir.
Eğitmenler, diğer kullanıcılara ya da diğer 3.şahıslara vereceği hizmetten kendisi sorumludur ve etik
kurallar gereği bu hizmetleri vereceğini şimdiden kabul ve taahhüt eder. Site, eğitmenlerin
veremediği hizmetlerde sorumluluk üstlenmez, taraf olmaz.
Site programın yayınını bakım ve güncelleme amaçlı herhangi bir zaman diliminde
geçici olarak durdurabilme ve öncesinde haberdar etmek üzere tamamen durdurabilme
hakkını elinde tutar. Üyeler hiçbir surette, ücretini ödemiş oldukları
hizmetin sonuna kadar sistemi kullanmaktan mahrum edilmez.
Yazılım ürününe, beraberindeki basılı malzemelere ve yazılım
ürününün (bunlarla sınırlı olmamak kaydıyla yazılım ürününe
eklenmiş her türlü görüntü, fotoğraf, canlandırma, video, ses, müzik,
metin ve mini uygulama ile gelişen teknolojiler nedeniyle meydana gelen yeni kayıt sistemleri de
dahil olmak üzere) bütün kopyalarına ait tüm tasarruf ve telif hakları
Site’ye aittir.
Güvenlik ve Gizlilik Politikası gereği, Site, kullanıcının, siteyi hatalı kullanımından veya
sayfa içeriklerinden doğacak olan hiçbir maddi veya manevi zararlardan sorumlu
tutulamaz. Doğası gereği internet bağlantılı hizmet veren tüm yazılım ve tüm servislerde
%100 güvenlik mümkün olmadığından ve %100 güvenlik vaat edilemeyeceğinden dolayı
‘’Site’’ yazılımlarında güvenlik amaçlı her türlü
tedbiri aldığını ve zaman içerisinde ortaya çıkabilecek olası eksiklik ve
açıkları gidermeyi taahhüt etmekle birlikte ‘’ Site’’ gerek
sehven yapılan veya düzenlenen gerekse zaman içerisinde ortaya çıkan ve/veya fark
edilemeyen hatalar, eksiklikler ve/veya açıklardan dolayı hiçbir maddi ve manevi
zararlardan sorumlu tutulamaz. Kullanıcı, iş bu kullanım şartlarını kabul etmiş sayılır.
Site kendi kontrolü altında olmayan başka internet sitelerine bağlantı veya referans
içerebilir. Site, bu internet sitelerin içerikleri veya içerdikleri diğer
bağlantılardan sorumlu değildir.
Site yazılımının tüm hakları Saas Bilgisayar, Reklam Tel. San. Tic. LTD ŞTİ’ye aittir.
Kullanılmış olan tasarım, grafik ve içerik kopya edilemez. Hiçbir şekilde izinsiz
çoğaltılamaz, dağıtılamaz ve pazarlanamaz. Aksi halde Türk Ceza Kanununun Bilişim
Suçları başlığı altında düzenlediği ilgili kanun ve hükümler uygulanacaktır.
Bu gibi kural ihlalinde bulunduğu belirlenen üyelerin kullanım haklarının iptali, Sitenin
inisiyatifindedir.
Alıcının, bu sözleşme hükümlerine aykırı hareket etmesi halinde, Site bu
sözleşmeyi tek taraflı olarak hemen sona erdirebilir. Bu durumda üyenin kullanıcı hesabı
dondurulur. Üyeye ait veriler sistem tarafından 3(üç) ay daha saklanmaya devam
edilir ve bu süre sonunda silinir.
Sistemde çerez (cookie/tanımlama bilgileri) kullanıldığını, çerezlerin bir internet
sitesinin kullanıcının bilgisayarındaki sabit diskte çerez dosyasına aktardığı bilgi
parçaları olduğunu, bunların kullanıcıların siteyi gezinmesine olanak sağladığını ve
gerektiğinde siteye erişen kullanıcıların ihtiyaçlarına uygun içeriklerin
hazırlanmasına yardımcı olmaktadır.
Kullanıcılar ve eğitmenler; tehdit edici, ahlak dışı, ırkçı, Türkiye Cumhuriyeti
kanunlarına, uluslararası anlaşmalara aykırı içeriğe sahip hizmet, mesaj, fotoğraf, metin
paylaşamaz.
Kullanıcılar, satılan hizmetin ayıplı, eksik veya hatalı çıkması halinde Site’ye durumu
doğrudan bildirmekle yükümlüdür. Bu gibi durumun olması halinde kullanıcılar
siteye hello@funnynative.com e-posta adresinden durumu bildirmelidir.
Sitenin kullanımı sırasında kaybolacak ve/veya eksik alınacak mesaj ve dosyalardan veya hizmetlerden
Site sorumlu değildir.
Sitede listelendiği halde satışa o an için sunulamaması veya kullanıcının satın aldığı bir
hizmetin verilmemesi durumlarında Site kullanıcıya bilgi vermek kaydı ile hizmetin para iadesi
yapılarak iptali sağlanacaktır.
Sitede satışa sunulan hizmetlerin fiyat ve özellik bilgilerinde hata oluştuğu takdirde Site
kullanıcıları bilgilendirerek, bu hatayı düzeltecek şekilde hizmet sunabilir veya siparişi
iptal edebilir.
Online yapılan ödemelerde, kartın hamili haricinde bir başkası tarafından hukuka aykırı şekilde
kullanılması halinde 23.02.2006 tarihli 5464 sayılı Banka Kartları ve Kredi Kartları Kanunu ve
10.03.2007 tarihli ve 26458 sayılı Resmi Gazete’de yayımlanan Banka Kartları ve Kredi Kartları
Hakkında Yönetmelik hükümlerine göre işlem yapılır.
Mesafeli Sözleşmeler Yönetmeliği kapsamında kullanıcılar satın almış oldukları hizmetin
kullanılmaması ve hizmetin ifasına 1 günlük süreden önce ve satın alınmasından
14 (on dört) gün içinde herhangi bir gerekçe göstermeksizin ve cezai
şart ödemeksizin cayma hakkına sahiptir.
Sitede yer alan bilgiler, fotoğraflar, linkler kopyalanarak başka bir hizmet için
kullanılamaz.
Üyeler diledikleri takdirde ve diledikleri zaman üyelikten çıkabilirler. Site aynı
şekilde herhangi bir uyarı yapmadan veya herhangi bir sebep göstermeden üyeliği iptal etme
hakkına sahiptir.
Site, mekanik, elektronik veya iletişimsel arıza veya bozulma gibi kendi inisiyatifi dışında
gerçekleşen nedenlerden kaynaklanan hatalar yüzünden, bu sözleşmede belirtilen
yükümlülüklerini yerine getirememekten sorumlu değildir.
Site, eğitmenlerin ya da kullanıcıların dikkatsizliği, tedbirsizliği sorumsuzluğu veya kusuru gibi
nedenlerden meydana gelecek herhangi bir olaydan sorumlu değildir. Kullanıcıların birbirine
verdikleri zararlar Site’ye rücu edilmeyecektir.
Kullanıcılar ve eğitmenler, sonucu can, mal kaybına yol açan veya Türk Ceza Kanunu
uyarınca suç teşkil eden tüm fiillerden şahsen sorumludur.
Kullanıcıların ve eğitmenlerin işbu sözleşmede belirlenen koşullara uymamasından dolayı
kendilerine veya diğer kullanıcılara gelebilecek zararlardan Site sorumlu değildir.
Üyeler, Tüketicinin Korunması Hakkında Kanun ve Elektronik Ticaretin Düzenlenmesi
Hakkında Kanun kapsamında Sitenin mesafeli sözleşme kurulmasına aracılık eden Aracı Hizmet
Sağlayıcı sıfatına haiz olduğunu ve Üyeler tarafından sağlanan içerikleri kontrol
etmekle, bu içerik veya içeriğe konu mal ve hizmetle ilgili hukuka aykırı bir
faaliyetin ya da durumun söz konusu olup olmadığını araştırmakla yükümlü ve
sorumlu olmadığını kabul, beyan ve taahhüt ederler. Kullanıcılar, hizmetin sunulmasından
kaynaklanan tüm sorumluluğun eğitmene ait olduğunu; internet sitesinin eğitmenler ve diğer
kullanıcılar arasındaki Mesafeli Satış Sözleşmesinin tarafı olmadığını ve Mesafeli Satış
Sözleşmesinden kaynaklanan yükümlülüğü bulunmadığını kabul, beyan ve
taahhüt ederler.
Kullanıcılar site’yi kullanırken ayrıca aşağıdaki kurallara uyacağını kabul ve taahhüt
eder;
- İçeriği hukuka aykırı yıldırıcı, tehdit edici, hakaret niteliğinde olan, genel ahlaka
aykırı, yakışıksız, edebe aykırı, pornografik, aşağılayıcı, karalayıcı, küfürlü,
lekeleyici ve benzeri her türlü bilgi ve görüşlerde bulunmamak,
- Kullanıcılar, eğitmenlere sosyal medya hesaplarından ulaşamaz, hiçbir şekilde mesaj
gönderemez ve rahatsız edemez.
- Eğitmen, iletişim bilgilerini kullanıcılar ile paylaşırsa doğabilecek tüm zarar ve
istenmeyen durumlardan kendisinin sorumlu olduğunu kabul eder.
- Kullanıcılar, maddi çıkar sağlamak amacıyla (para, kontör, kredi kartı bilgileri)
isteyemez, kendisine ait banka hesap bilgisi paylaşamaz ve/veya dolandırıcılığa yeltenemez.
- Kullanıcılar birbirleriyle hiçbir şekilde kişisel bilgilerini (e-posta, telefon, adres,
vb.) paylaşamaz.
- Görüşme esnasında T.C yasalarına ve Türk aile terbiyesi dışına çıkmaya
kalkışmak,
- Devlet büyüklerine hakaret etmek ya da küçük
düşürücü hareketler ya da konuşmalarda bulunmamak,
- Görüşme esnasında; din, siyaset, ırkçılık, cinsellik, pornografi vb. gibi
konularda konuşmamak, bu tür hareketlerde bulunmamak,
- Görüşme esnasında yapılan kullanıcıların kendi iradesiyle yaptığı konuşmalardan
sitemiz sorumlu tutulamaz. Kullanıcı, rahatsız olduğu bir durumla karşılaştığında bunu siteye
e-posta yoluyla bildirmelidir.
- Site, İngilizce eğitimi, eğitim randevusu amacının dışında kullanılamaz (Site’ye yazılı
olarak bildirilmeden ve site’nin rızası olmadan gerçek dünyada buluşmak, adres
veya buluşma yeri belirterek bir araya gelmek vb.) Kendi iradesiyle böyle bir davranışta
bulunan tüm kullanıcıların karşılaşacağı olumsuzluklardan site kesinlikle sorumlu
tutulamaz.
- Kullanıcılar görüşme esnasında başka sitelerin, marka, ürün, hizmet değeri
taşıyan farklı ürünlerin reklamını ve tanıtımını kesinlikle yapamaz. Bu tür
davranışlarda bulunan kullanıcılar sistemden atılır ve engellenir.
- Platformla ilişiği kesilen uzmanlar, mevcut öğrencileri/kullanıcılarıyla olan
süreçleri tamamlanana kadar ana sayfada görünmese bile hizmet vermeyi
kabul ve taahhüt ederler.
Yukarıdaki listelenen kuralların dışına çıktığında doğabilecek tüm zarardan sorumlu
olduklarını ve Site’nin bu zararlardan sorumlu olmadığını kabul eder. Ayrıca site, bu tür
davranışlarda bulunan kullanıcıları sistemden atmayı, engellemeyi ya da yetkili mercilere bildiride
bulunma hakkını elinde saklı tutar.
Kullanıcılar, aralarındaki mesafeli satış sözleşmesinden kaynaklı doğacak ihtilaflardan dolayı
Sitenin, idare ve yargı kararları dahil olmak üzere, herhangi bir zarara uğraması halinde
onaylamış oldukları Site üyelik sözleşmesi ve sitedeki diğer kurallar kapsamında Sitenin
söz konusu zararları kendilerine rücu etme hakkı olduğunu kabul ederler.
Mesafeli Satış Sözleşmesinin akdedilmesi Üyelerin ayrı ayrı Site ile akdetmiş oldukları
işbu üyelik sözleşmelerinin hükümlerinin ifasını engellemeyecek olup Üyeler
mesafeli satış sözleşmesi konusu hizmetin satışında Sitenin herhangi bir şekilde taraf
olmadığını ve Sözleşme kapsamında tarafların yükümlülüklerini yerine
getirmeleri ile ilgili herhangi bir sorumluluğu ve taahhüdü bulunmadığını kabul ve beyan
ederler.
Bu sözleşmenin herhangi bir hükmü uygulanamaz veya geçersiz addedilirse, bu
geçersizlik sadece bu durum ile sınırlandırılır ve sözleşmenin geri kalan kısmı tamamen
geçerliliğini korur.
Hukuken mücbir sebep sayılan tüm durumlarda, taraflar bu sözleşmeden ve projeden
kaynaklanan taahhütlerinin herhangi birini geç ifa etme veya ifa etmeme nedeniyle
yükümlü değildir. Bu ve bunun gibi durumlar taraflar açısından gecikme ve ifa
etmeme veya temerrüt sayılmayacak veya bu durumlar için herhangi bir tazminat
yükümlülüğü doğmayacaktır. “Mücbir sebep" terimi, ilgili tarafın
makul kontrolü haricinde ve tarafların gerekli özeni göstermesine rağmen
önleyemediği olaylar olarak yorumlanacaktır. Bunun yanında sınırlı olmamak koşuluyla, doğal
afet, isyan, savaş, grev, iletişim sorunları, altyapı ve internet arızaları, elektrik kesintisi ve
kötü hava koşulları gibi durumlar mücbir sebep olaylarına dahildir. Mücbir
sebeplerden birinin oluşması durumunda, bir taraf diğer tarafa 15 (onbeş) gün içinde
herhangi bir yolla bildirimde bulunarak Sözleşme hükümlerini askıya alabilir,
mücbir sebep halinin üç aydan fazla sürmesi halinde ise taraflar
sözleşmeyi feshedebilirler.
İşbu sözleşmeden kaynaklanan her türlü uyuşmazlıkların çözümünde
İstanbul Mahkeme ve İcra Dairelerinin yetkili olduğunu Taraflar kabul etmişlerdir.
Bu sözleşme alıcının sisteme üye olduğu tarihten itibaren üyeliğini sonlandırana kadar
geçerlidir.
